Home Information Pack (HIP) Terms and Conditions

 
1. Introduction
1.1 This agreement (“the Agreement”) for the purchase of a Home Information Pack ("HIP") is made between My-HIP-Plus a division of Highgrove Property Search Agency "We" and “Us”) and the customer ("You").
1.2 In entering into this agreement you are confirming you have read these Terms and Conditions and agree to them.
1.3 Once a cleared payment is received you agree to My-HIP-Plus producing a HIP for you ("the Order") and this agreement is legally binding and subject to
the laws of England and Wales.
 
 
2. Your Responsibilities
2.1 You affirm that you have the legal right to sell the property.
2.2 Any information that you supply is true and accurate and not misleading. My-HIP-Plus does not have any responsibility for the accuracy of the information supplied and cannot be held liable for any innaccuracy.
2.3 The fee quoted will be paid by you before the production of the HIP is commenced.
2.4 You agree to pay any additional costs incurred by My-HIP-Plus to produce the HIP prior to the completed HIP being released including but not limited to: i. inability to gain entry to premises for energy assessment and/or home condition report: ii. customer supplying incorrect information: iii. the obtaining of leasehold or commonhold information and/or management charges: iv. information required under the HIP Regulations as amended from time to time in addition to that already charged for.
2.5 Where your property is leasehold or commonhold you will provide us at the earliest opportunity with contact details including name and email address of any solicitor or conveyancer appointed by you for the provision of the statutory leasehold or commonhold information required for inclusion within the HIP.
2.6 You will ensure full access for a Domestic Energy Assessor to the property on the agreed date. Failure to provide access will result in an extra call out charge.
2.7 You will ensure full access for a Home Inspector to the property on the agreed date in the event of your choosing this additional report.
2.8 You will have or install the appropriate software to read PDF files e.g. Adobe Reader for receiving the HIP electronically.
2.9 You undertake to supply copies of your HIP to interested parties on request and store the master copy.
 
         
3. My-Local-HIP’s Responsibility
3.1 The right to reject or cancel an order at anytime is reserved by us.
3.2 Your HIP will contain the compulsory documents as defined by the "Home Information Pack Regulations" in force or as amended from time to time.
3.3 A Domestic Energy Assessor instructed by us will contact you generally within two working days of the order to arrange the energy assessment visit to the premises.
3.4 The Energy Performance Certificate will be supplied in electronic PDF file form normally within five to seven working days after the energy assessment has taken place. 
3.5 The completed HIP will normally be supplied within seven to fourteen days of the order. Leasehold and commonhold properties will take longer to produce. However, as local and water and drainage searches are subject to supply by other authorities and entities please allow 28 days or longer in exceptional circumstances.
3.6 We will inform you by email when the order is complete and supply instructions on how to download your HIP.
3.7 The HIP is your property and you may use it for marketing of your property including private advertising through the internet or other media or by an Estate Agent/Agents as well as for the purposes of conveyancing.
3.8 We will, on receipt of cleared payment for your HIP provide an online or email link to a private house sale website not owned or controlled by us for you to upload your details and one photograph free of charge.
3.9 Any link or advertisement on our website to any third party is supplied or published in good faith by us. We do not make any warranty or representation as to the accuracy or fitness for purpose of any third party material or the reliability of access to the said sites or to any information or operation of any link or advertisement provided on the My-HIP-Plus website.
3.10 In the event that you purchase or obtain any goods or services from a third party then your acquisition of such goods or services will be in accordance with the third party’s terms and conditions and MY-HIP-Plus will have no liability to you in respect of the same.
3.11 We will, to the best of our endeavours, ensure that the My-HIP-Plus web site is available at all times. We reserve the right without prior notice to take the site offline for essential maintenance and upgrades.
 
 
4. Refunds
4.1 A Home Information Pack can be cancelled within 24hrs of ordering by email or phone subject to any costs incurred. A Hip cannot be cancelled after 24hrs as work will have commenced to produce your HIP.
4.2 If you cancel your HIP we will refund your fee less any costs incurred. These costs incurred include but without limitation ordering an Energy Performance Certificate, local searches, drainage search, land registry search, ancillary searches as ordered by you in addition to the compulsory searches plus any other work to compile your HIP.
4.3 The supply of Home Information Packs is classed as "goods made to the consumer's specifications or clearly personalized" and is therefore excluded from the “Distance Selling Act”.
4.4 Our liability will in no circumstances exceed the value of the cost of supplying the HIP
4.5 We are not liable for any error in the HIP based on information including and not limited to information from the public register, energy assessor, local searches, information provided by the seller, leaseholder or managing agents.
4.6 This does not affect your statutory rights as a consumer or under the “Home Information Pack Regulations”.
